MARSHALL — A Tracy appliance business owner is facing multiple charges including racketeering and six counts of theft by swindle, according to Lyon County court records. 53-year-old Darin Lee Horner of Garvin, former owner of Affordable Appliance Plus in Tracy, appeared in court on Tuesday.
The criminal complaint alleges Horner committed three or more acts of theft by swindling by accepting payments for appliances, and then never delivering them. The criminal complaint alleges the events occurred between March 2017 and June 2019. Over 40 complaints were logged with the Tracy Police Department in October 2018 from people that never received the items they paid for. The complaint also alleges Horner used thousands of dollars of customers’ payments for personal spending, vacations, and a contract for deed for a property.
A future hearing date for Horner has been set for December 19th.
