TRACY, Minn. — A Lyon County court has sentenced Darin Lee Horner to 364 days in jail and five years of probation for theft by swindle tied to multiple customer complaints in Tracy.
Horner pleaded guilty in August 2025 to two counts of theft by swindle after admitting he took money from customers between 2017 and 2019 without ordering or delivering the appliances they purchased. Court records say the money was instead used for other purposes, including deposits to Horner’s personal account to make house payments.
Horner operated Affordable Appliance Plus in Tracy until May 1, 2019. Dozens of customers paid for appliances they never received during the period. The case was prosecuted by the Minnesota Attorney General’s Office following a referral from the Lyon County Attorney under state statute. The investigation involved the Minnesota Bureau of Criminal Apprehension and the Tracy Police Department.
