MARSHALL – A Sioux Falls man will serve probation after striking a person in the head with the magazine of a pistol during a fight, according to Lyon County court records. 18-year-old Paul Daniel Schwartz pleaded guilty on Tuesday for charges of Fifth Degree Assault and Carrying a Firearm without a Permit.  

According to the criminal complaint, Schwartz got into a fight on Lucille Street on June 30th of this year. During the fight, Schwartz grabbed an AR-15 style pistol and physically struck another person on the head with the gun’s magazine. 

Schwartz was sentenced to 364 days in jail, with 349 days stayed for the Carrying a Firearm without a Permit charge. Conditions must be met including no possession of a firearm or dangerous weapon, and no contact with the other parties involved in the incident. The assault charge earned Schwartz one year of probation and a $400 fine.  

As part of the plea agreement, four other charges were dismissed.
